2. RNZRSA RULES – CAPITATION

4. Capitation 2010/2011 – Local Associations and RSA Clubs
- That pursuant to the provisions of Rules 56 and 57 of the RNZRSA’s Rules, the capitation to be paid by local Associations and separately incorporated RSA Clubs for the financial year 1 July 2010 to 30 June 2011 shall be an amount of $10.00 + GST for each member aged less than 90 years in respect of all classes of members based on membership as at 31 December 2009, as certified by a statutory declaration completed by the Secretary or President of the local Association or separately incorporated RSA Club, plus GST at the prescribed rate for that year, and
- That the amount of capitation remains at the same level for the financial years 1 July 2011 to 30 June 2012 and 1 July 2012 to 30 June 2013.
ASSOCIATION MATTERS
3. POPPY FUNDS – RNZRSA POLICY
THAT THIS COUNCIL DIRECTS ALL LOCAL ASSOCIATIONS RECEIVING DONATIONS FROM THE PUBLIC FROM POPPY DAY COLLECTIONS TO ESTABLISH A DEED OF TRUST ENTITLED “(ASSOCIATION NAME) POPPY DAY TRUST” WITH A SEPARATE ACCOUNT AND THAT THE DEED OF TRUST BE REGISTERED TO ENSURE THAT THE FUNDS DONATED ARE PROTECTED; AND THE ACCOUNTS OF THE DEED OF TRUST BE INCLUDED IN THE ANNUAL ACCOUNTS OF THE ASSOCIATION AND THAT THIS RNZRSA POLICY TO BE MANDATORY FOR LOCAL ASSOCIATIONS

Currently RNZRSA has no specific policy relating to the protection of monies donated by the public to local Associations as Poppy Day donations. Concern has been expressed that if a local Association merges with another organisation, or ceases to operate, any poppy funds that are not suitably protected by a specific Deed of Trust, could be viewed as liquid assets of that local Association, and open to disbursement to debtors. It would also be prudent to be able clearly to counter in public any suggestion, insinuation or allegation of inappropriate use of such funds.
This policy would require local Associations who receive funds collected as Poppy Day donations to place those funds in a specific Trust Account, with a Deed of Trust to ensure that the uses are adequately protected. A local Association would be required to register the Deed of Trust and provide a copy of the Deed of Trust to RNZRSA National Office. A draft Deed of Trust would be made available to local Associations free of charge by RNZRSA National Office to assist them.
4. POPPY DAY FUNDS – USE OF
THAT ALL RETURNED AND SERVICES ASSOCIATIONS AND BRANCHES BE GIVEN THE OPTION TO USE POPPY DAY APPEAL FUNDS FOR ALL EX SERVICEMEN AND WOMEN, THEIR SPOUSES AND THEIR IMMEDIATE DEPENDENTS IN THEIR LOCAL COMMUNITY.

- Section 10 of the Pension and Welfare Manual states: “In recent years it has become the norm for many RSAs to inform their donors that the Poppy Day appeal funds will be used for “all” ex servicemen and women, and their immediate dependents within the local community, this allows a wider distribution of funds collected.”
There appears to be a precedent that the Welfare Manual statement is to be preferred.
5. NATIONAL COUNCIL 2012 – CHANGE OF VENUE
THAT THE NATIONAL COUNCIL MEETING IN 2012 BE HELD IN PALMERSTON NORTH.

National Council expenses in 2008 were $90,451, of which $49,878 were for hall hire. The budget for 2009 National Council was $105,000, and the projected budget for 2010 National Council was $110,000.
There can be a saving of at least $30,000 on hall hire if the Palmerston North Convention Centre is used as a venue.
6. NATIONAL COUNCIL 2015 – CHANGE OF VENUE
THAT THE 2015 RNZRSA NATIONAL COUNCIL BE HELD IN CHRISTCHURCH.

In November 1915 the Christchurch Returned Soldiers club was formed. This was the first soldiers club in New Zealand and the birth of the RNZRSA as we know it today.
In October 2015 the Christchurch Returned and Services’ Association intends to hold a vice-regal opening of the new multi-storey building which will be the home for the Christchurch Returned And Services’ Association Inc, for the next 100 years. This event will be the start of the 100 year celebrations.
If the RNZRSA National Conference is held in Christchurch at the same time this would also coincide with the opening and will show the public of New Zealand that the RNZRSA is a growing and dynamic organisation who moves with the times and will be present for many years to come.
7. RNZRSA STANDING POLICY 2008/13
THAT RNZRSA STANDING POLICY AT 2008/13 BE AMENDED AS FOLLOWS:
Current policy:
“That all local Associations be requested to amend their rules to enable financial Associate members of a local Association to stand for election to any position on a local Association Executive Committee, including President and Vice President and that all local Associations be required to make the appropriate amendments to their rules by 31 December 2010.”
Amended policy:
“That all local Associations who may wish to amend their rules to enable financial Associate members of a local Association to stand for election to any position on a local Association Executive Committee, including President and Vice President may do so.”

- Membership ratios of local Associations vary around the country, and in a number of instances the proposed change is entirely appropriate
- Some Associations still have a significant majority of Returned and Service persons, who see the policy proposal as a threat to their Associations
- The imposition of the policy as it presently stands is, under those circumstances, unnecessarily divisive
- Each Association should have the ability to make their own decision as to when it is appropriate to implement the policy.
8. PUBLIC LIABILITY INSURANCE
THAT PUBLIC LIABILITY INSURANCE TO COVER ALL ASSEMBLIES ORGANISED BY LOCAL RSA BRANCHES BE TAKEN OUT BY RNZRSA.

In the unfortunate event of injury or damage happening that can be attributed to the organisers costs may be incurred.
There is no uniformity of insurance cover with Branches and Sub Branches being left to organise their own if they can afford the cost. We have first hand understanding of this as the cheapest quote we could obtain was $450.
9. HERITAGE (INC)
THAT THIS NATIONAL COUNCIL INSTRUCTS DISTRICT PRESIDENTS TO FIND OUT, THROUGH LOCAL RSA PRESIDENTS, IF THERE ARE ANY FAMILIES OF DECEASED SERVICEMEN AND WOMEN AND DEPENDENTS OF EX SERVICEMEN AND WOMEN OF NEW ZEALAND, IN THEIR DISTRICT IN NEED OF ADVICE AND GUIDANCE, AND THAT DISTRICT PRESIDENTS FORWARD THIS INFORMATION TO THE SECRETARY OF HERITAGE (INC) AND RNZRSA NATIONAL OFFICE.

Heritage (Inc) was established in 1942 to assist sons, and daughters who had lost their fathers in war.
“The Object of the Organisation was to make available to the children of servicemen who have given their lives for their country a service of advice and guidance such as would have been provided by their father and to assist in all matters pertaining to the education, development and advancement in life of such children and to render such other services as may be thought desirable in the interests of the children of all servicemen.”
It is felt that those in need are not aware of the assistance available for educational purposes for the children of service and ex service personnel.
RULES
10. RNZRSA RULES – AMENDMENT
ELECTION OF NATIONAL PRESIDENT AND NATIONAL VICE PRESIDENT
18(b) THAT NOMINATIONS FOR THESE OFFICES SHALL BE MADE BY LOCAL ASSOCIATIONS AND MUST BEAR THE ACCEPTANCE THEREON OF THE PERSON NOMINATED AND MUST BE IN THE HANDS OF THE CHIEF EXECUTIVE NOT LATER THAN A DATE SEVEN (7) WEEKS PRIOR TO THE DATE OF NATIONAL COUNCIL IN EACH YEAR. THE NAMES OF SUCH NOMINEES SHALL BE POSTED TO THE LOCAL ASSOCIATIONS AT LEAST FIVE (5) WEEKS PRIOR TO THE DATE OF NATIONAL COUNCIL.

Currently nominations for the positions of National President and two National Vice Presidents close six (6) weeks prior to the date of National Council. It is suggested that time for the receipt of nominations be extended to seven (7) weeks to tie in with the receipt date for Remits.
11. RNZRSA RULES – AMENDMENT

21. THAT THE NAMES AND APPOINTMENTS OF ALL DELEGATES SHALL BE DELIVERED TO THE CHIEF EXECUTIVE NO LATER THAN SEVEN (7) WEEKS PRIOR TO THE DATE OF NATIONAL COUNCIL.

Because of significant delays by local Associations and RSA Clubs in forwarding the form listing their respective Delegates and Observers attending National Council, National Council is requested to consider extending out the time from National Council when this information is required. This would enable National Office staff additional time to follow up late responses.
12. RNZRSA RULES – AMENDMENT
40. REMITS
(a) THAT NEC OR ANY LOCAL ASSOCIATION OR ANY DISTRICT MEETING OF LOCAL ASSOCIATIONS OR ANY AFFILIATED ORGANISATION WHICH DESIRES TO BRING FORWARD ANY REMIT TO A MEETING OF THE COUNCIL SHALL FORWARD A COPY OF SUCH REMIT TO THE CHIEF EXECUTIVE ON OR BEFORE A DATE SEVEN (7) WEEKS BEFORE THE DATE FIXED FOR THE MEETING OF THE COUNCIL WHICH SHALL BE THE FINAL DATE FOR THE RECEIPT OF SUCH A REMIT.
(d) THE CHIEF EXECUTIVE SHALL FORWARD A COPY OF ALL REMITS TO ALL ASSOCIATIONS ENTITLED TO REPRESENTATION AT MEETINGS OF THE COUNCIL, BY A DATE AT LEAST FIVE (5) WEEKS BEFORE THE MEETING OF THE COUNCIL AT WHICH SUCH REMIT IS TO BE CONSIDERED.

The points to note that in Rule 40 (a) Remits are required to be submitted to the Chief Executive ten (10) weeks before the date of National Council.
In Rule 40 (d) the Chief Executive is required to ensure that all Associations shall have a copy of the Remits forwarded to them at least six (6) weeks prior to the date of National Council.
It is recommended that given the many forms of current communication there is good reason to shorten the above periods to seven (7) weeks for the receipt of Remits, and four (4) weeks for the remits to be sent out to local Associations for consideration.
13. RNZRSA RULES – AMENDMENT

56. Returned, Service and Associate Members
Local Associations shall pay capitation each year of an amount, and for each class or group of members, as determined from time to time by the Council, by
(a) two equal instalments due 31 March and 30 September, or
(b) in instalments of a lesser or greater frequency as may be approved by NEC
Rule 56 (a) states that capitation be paid in “two equal instalments due 31 March and 30 September”
These instalment dates were established when the financial year of RNZRSA was 1 January to 30 December.
With the financial year of the RNZRSA being changed to 1 July – 30 June each year there is a need to amend the two instalment dates to recognise this change of financial year.
14. RNZRSA RULES – AMENDMENT
CAPITATION AND FINANCE SERVICES AND CITIZENS TYPE CLUBS
58. THAT EVERY AFFILIATED SERVICES AND CITIZENS TYPE CLUB SHALL PAY TO THE CHIEF EXECUTIVE BY NO LATER THAN 30 SEPTEMBER EACH YEAR AN AFFILIATION FEE OF AN AMOUNT AS DETERMINED FROM TIME TO TIME BY THE COUNCIL.

59. THAT EVERY AFFILIATED ORGANISATION SHALL PAY TO THE CHIEF EXECUTIVE BY NO LATER THAN 30 SEPTEMBER EACH YEAR AN AFFILIATION FEE OF AN AMOUNT AS DETERMINED FROM TIME TO TIME BY THE COUNCIL.

The above two Rules require that Services and Citizens type Clubs and Affiliated Organisations shall pay to the Chief Executive by no later than 31 March each year an affiliation of an amount as determined from time to time by National Council.
With the change of the RNZRSA Financial year to 1 July – 30 June, Rules 58 and 59 needed to be amended.
15. RNZRSA RULES – VOTING ENTITLEMENT AT NATIONAL COUNCIL
THAT THE VOTING ENTITLEMENT OF LOCAL ASSOCIATIONS ATTENDING NATIONAL COUNCIL BE AMENDED FROM THE PRESENT VOTING STRUCTURE, AND REPLACED WITH THE FOLLOWING VOTING STRUCTURE: TWO (2) VOTES PER LOCAL ASSOCIATION WITH UP TO 1,000 MEMBERS, PLUS ONE (1) ADDITIONAL VOTE FOR EVERY 500 MEMBERS FOR WHOM THE LOCAL ASSOCIATION PAYS CAPITATION.

Currently Rule 13 (a) provides a mechanism by which a local Association, RSA Club or Affiliated Organisation can be suspended by resolution of NEC if capitation has not been paid. The new Rule will relate specifically to non-payment of capitation.

All of the above organisations are either Crown entities or voluntary organisations that provide vital services and have close links with the communities that they serve. In many cases, if it were not for the activities of these organisations and their commitment to ensuring that remembrance of the RNZRSA principles are observed and continued through their organisation and management of annual ANZAC Day and Remembrance Day services these important services would not survive in many of our rural areas where RSA clubs have succumbed to the passage of time and the sad passing of local RSA members.
Many of our Rural RSA’s have closed due to the lack of members, yet in these small communities, the service organisations continue to hold the ANZAC and RSA flag high in their community. If these organisations are given the ability to hold the service member category it will bolster the membership of the grassroots RSA’s throughout New Zealand and enable the surviving rural RSA clubs to continue to uphold and foster our values throughout New Zealand.
We have noted that RNZRSA has invited these organisations to nomination appropriate persons to receive the ANZAC of the Year Award. This appears to be a bit of a contradiction to Christchurch RSA if we will not allow these people to be members of the RSA movement.
When the M&M report was written one of the recommendations was that we change our name from ‘Returned Service Association’ to ‘Returned and Services Association’. We believe that the name change signalled by the authors of the report was to be all encompassing for service organisations in New Zealand. We also believe that unless we open our doors to a wider range of service members then the grassroots rural RSA’S will die. Remember what happened when the NZ rugby union turned its back on the grassroots rugby a number of years ago, it nearly killed rugby in this country! Do we, in our lifetime, want to be the ones who killed the rural grassroots RSA’S because we refuse to develop, change, and adapt to the community.
The Order of St John in New Zealand, whose Sovereign Head is Queen Elizabeth II, are awarded Queens Honours and Decorations in recognition of the members’ contributions to their communities. The St John honours are recognised within the order of precedence of all Orders, Honours, Decorations and Service Awards recognised within New Zealand. St John’s contribution to the country’s armed forces in times of conflict is recognised in the hall of the National War Memorial at Wellington. The New Zealand Customs service is a uniformed border protection service and under the Customs Act all Customs Officers hold rank in the New Zealand Navy and can be awarded Queens Honours and Medals. They have also in recent times served alongside our Defence and Police forces in the reconstruction and peace keeping deployments in East Timor and the Solomon Islands. Likewise the staff, (paid and volunteer) of the New Zealand Fire Service are also awarded Queens Honours, Decorations and awards.
24. EMERGENCY SERVICE MEMBERSHIP
THAT A NEW CATEGORY OF MEMBERSHIP BE ADDED BEING “EMERGENCY SERVICE MEMBERSHIP” TO THE RULE 9 OF RNZRSA RULES AND ALL OTHER RULES PERTAINED IN THE RNZRSA RULES.

- THAT THE RULES FOR THE CONDUCT OF RNZRSA NATIONAL SPORTING TOURNAMENTS BE APPROVED BY THE NATIONAL EXECUTIVE COMMITTEE.
- THAT THE HOST ASSOCIATIONS ENSURE THAT THE TOURNAMENT COMMITTEE INCLUDES AN OFFICE BEARER OR SERVING MEMBER OF THE ASSOCIATION’S EXECUTIVE.
- THAT ALL PARTICIPANTS IN NATIONAL SPORTING TOURNAMENTS SHALL BE RESTRICTED TO FINANCIAL RETURNED, SERVICE, ASSOCIATE AND YOUTH MEMBERS (MEN AND WOMEN) OF AN AFFILIATED RSA EXCEPT FOR DARTS WHICH REMAIN RESTRICTED TO RETURNED AND SERVICE MEMBERS ONLY.
- THOSE MEMBERS WITH DUAL MEMBERSHIP BE REQUIRED TO NOMINATE THE ASSOCIATION THEY WISH TO REPRESENT IN RNZRSA NATIONAL SPORTING TOURNAMENTS. NO MEMBER MAY PARTICIPATE IN MORE THAN ONE ELIMINATION TOURNAMENT IN ANY SPORT.
- THAT ANY LOCAL ASSOCIATION WHICH WILFULLY INCORRECTLY CERTIFIES A PERSON AS ELIGIBLE FOR ANY NATIONAL SPORTING TOURNAMENT SHALL BE BARRED FROM BEING REPRESENTED AT THE FOLLOWING YEARS TOURNAMENT (1988).
AND THAT THE NEW POLICY APPLY FROM 1 JANUARY 2011

THAT THE STANDING POLICY RELATING TO POLICY 14.6.1 ENTITLED “ELIGIBILITY” TO BE AMENDED TO READ: THAT ALL PARTICIPANTS IN NATIONAL SPORTING TOURNAMENTS SHALL BE RESTRICTED TO FINANCIAL RETURNED, SERVICE, ASSOCIATE AND YOUTH MEMBERS (MEN AND WOMEN) OF AN AFFILIATED RSA EXCEPT FOR NATIONAL DARTS, WHICH REMAINS RESTRICTED TO RETURNED AND SERVICE MEMBERS ONLY.
VICTORY CLUB OPEN DARTS TOURNAMENTS ARE OPEN TO YOUTH MEMBERS AND FINANCIAL MEMBERS OF AN AFFILIATED RSA (RETURNED, SERVICE, ASSOCIATE AND CLUB).

29. LOCAL ASSOCIATION RULES – SEVENTH SCHEDULE
THAT THE SEVENTH SCHEDULE TO THE STANDARD RULES FOR LOCAL RETURNED AND SERVICES’ ASSOCIATIONS BE REPEALED AND REPLACED WITH THE FOLLOWING SCHEDULE:
SEVENTH SCHEDULE
LICENCE REGULATIONS
- The sale, supply and consumption of liquor shall only occur in accordance with the provisions of the Sale of Liquor Act 1989 and the terms and conditions of any license issued pursuant to that Act.
- No liquor shall be sold or supplied to minors, intoxicated persons or to otherwise prohibited persons (within the meaning of the Sale of Liquor Act 1989 or any re-enactments thereof or any amendments thereto) except those allowed in accordance with the terms of the Sale of Liquor Act 1989 or any re-enactment thereof or amendments thereto.
- Every RSA licensed to sell liquor in accordance with the provisions of the Sale of Liquor Act 1989 shall have a Host Responsibility Policy and be in compliance with the Policy at all times the premises are open for business.
- Licences
A club licence shall authorise the holder of the license to sell and supply liquor, on the premises described in the license, for consumption on the premises, to -
- any member of the club; or
- any person who is a guest of, and is accompanied by, a member of the club; or
(c) any member of any other club with which the holder of the license has an arrangement for reciprocal visiting rights for members of the clubs.
Members are responsible for the conduct of their guests and must ensure that guests leave the premises at the same time or before they do.
An on-licence authorises the holder of the licence -
- To sell and supply liquor, to any person present on the premises described in the licence, for consumption on the premises and
(b) To allow the consumption of liquor on the premises described in the licence
An off-licence shall authorise the holder of the licence to sell or deliver liquor on or from the premises described in the licence to any person for consumption off the premises.
Liquor is to be sold or supplied only to:
- Any member of the club; or
- Any member of any other club with which the holder of the licence has an arrangement for reciprocal visiting rights for member of the club.
The holder of an off-licence may arrange for delivery to be made by the maker, importer, wholesaler, or distributor of any liquor from the premises of the maker, importer, wholesaler, or distributor; and, in any such case, the liquor shall be deemed for the purposes of this Act to have been delivered by the holder of the off-licence from the premises described in the licence.
An off-licence also authorises the complimentary supply of liquor by way of sample on the premises to which the licence relates.
A special licence authorises the holder of the licence to sell and supply liquor, on the premises described in the licence, to any person attending any occasion or event or series of occasions or events described in the licence.”
Special licences for social gatherings. Without limiting anything in the above section, a special licence may be granted in accordance with this Part to the holder of an on-licence or to the holder of a club licence, authorising the holder from time to time to sell and supply liquor for consumption on the premises at any time when the premises are required to be closed for the sale of liquor, to persons attending social gatherings of any kind or kinds specified in the licence.
On any day/evening that a special licence is in force, it is necessary to provide a form at the principal point of entry to the Club, for event attendees to sign on arrival. The Form should be headed with the date and name of the function with two columns below, for attendees to print their name with their signature beside. This is to satisfy regulatory bodies that visitors are indeed on the premises to attend the listed event.
The holder of either a current Club Manager’s or General Manager’s Certificate issued in accordance with the provisions of the Sale of Liquor Act 1989 must be in attendance on the premises whenever the public is present.
Liquor consumed at any occasion or event for which a special licence applies, must be provided through or by the local Association or Club.
Only financial members of the RSA should host functions for which a special licence is required
- No gambling or gaming shall be permitted on the premises other than in accordance with any licence or permit issued pursuant to the Gambling Act 2003.
- Nothing in these Regulations shall be deemed to limit the power of the Executive Committee to make By-laws for the conduct of the licensed premises provided that where necessary approval will be sought from RNZRSA.
